Background
During the July 13, 2026, City Council meeting, City Manager Krishna Namburi shared under general comments at the start of the meeting that staff had been working with developer Verrus under a non-disclosure agreement (NDA) to develop a $5.1 billion AI data center at the Mill Creek Corporate Center, called Oakline at Mill Creek. The City Manager signed the NDA on March 27, 2025, at the request of Verrus in order for the developer team and staff to meet without any public scrutiny during the “due diligence” and “pre-application” phase. This time was not only to assess the viability of the site and project, but also included preliminary engineering and City feedback on development code requirements. Ultimately, a formal land use application was submitted two weeks later, on July 30, 2026.
The proposed project originally included a parcel owned by the State of Oregon at the west end of the project area. After the public outcry against the proposed project, on July 30, Governor Tina Kotek instructed staff to cancel the purchase and sale agreement with the developer. However, that did not stop the project because several days later, the proposed project was submitted with Lots 1, 2 and 4, and not Oregon state-owned Lot 3.
On August 3, 2026, in response to significant public pushback, the City Council considered and unanimously directed staff to prepare a moratorium on any AI Data Centers. The process will take about 50-60 days to become effective, following a public hearing that has been tentatively scheduled for September 28, 2026. Stay tuned for more information.
